Angel Paws USA Services Agreement

1. Owner Certification

• Property: I certify that I am the legal owner or authorized representative/agent of the deceased pet.
• Disposal Rights: I confirm that I possess the legal right to control/determine the disposition of the pet's remains.

2. Service Authorization

• Full Authorization: I/We grant full authorization for Angel Paws USA to perform/undertake all necessary actions to complete the pet funeral services, including transportation, cremation, euthanasia, burial, and any other associated services according to the selected package.
• Cremation: If cremation service is chosen, I authorize the removal and cremation of the pet.
• Euthanasia: If euthanasia service is selected, I grant permission for the euthanasia procedure, followed by removal and cremation.
• Burial: For burial services, I authorize the removal and burial of the pet.
• Autopsy/Necropsy: If an autopsy or necropsy is chosen, I authorize a postmortem evaluation of the pet.

3. Transport General

• Transport Permit: I allow Angel Paws USA and its partners to arrange or assist in the transportation of the remains, including transportation to/from my home, an autopsy facility, or a crematory.
• Documentation: I agree to provide or assist in obtaining the necessary documentation to thoroughly investigate the cause of death.

4. Partner Program Authorization

Authorization: For services associated with the Partner Program, I authorize cremation and/or removal as necessary.

5. Declaration of Exposure to Rabies

• Rabies Exposure: To the best of my knowledge, my pet has not bitten, scratched, or potentially exposed any person or other animals to rabies within the preceding ten (10) days.
• Rabies Test: I understand that should the described animal have bitten or potentially exposed any person within the specified timeframe, a rabies test is required. We will not handle such cases, as the head must be sent to a laboratory.

6. Knowledge about Euthanasia

• Understanding: I understand that euthanasia is the humane act of ending an animal's life to prevent unnecessary suffering.
• Precision: I guarantee that all information I have provided is accurate and complete.
• Immediate Execution: By signing this agreement, I understand that my wishes may be carried out immediately.
• Process: The euthanasia process includes a sedative, anesthesia, and finally, a drug to stop the heart.

7. Selection of Transport and Vehicle

• General Understanding: I/We acknowledge that during the transportation of my pet from the pick-up location to the pet funeral services and crematory, Angel Paws USA reserves the right to determine the type of vehicle used, which may include cars, vans, SUVs, or pickups. The choice of vehicle will be based on logistical considerations, including the size and weight of the pet.
• Transporting Multiple Pets: I/We also acknowledge that Angel Paws USA may transport more than one pet at a time for efficiency. We understand that all pets will be handled with care and respect during transportation.
• Commitment to Punctuality: Angel Paws USA will endeavor to arrive at the pick-up location within an estimated time of 1-3 hours, providing prompt and compassionate service to pet owners during their time of need.

8. Variable Response Time

General Understanding: I/We understand that response times for removal may vary due to factors such as call volume and unforeseen circumstances. Although we strive to be timely, wait times may exceed 1-3 hours. Customers will be informed of expected response times, and no refund will be issued if the response time is within 12 hours. Refunds will be offered if pickup cannot be completed the same evening.

9. Crematorium Selection

Choice of Crematory: I/We acknowledge that Angel Paws USA operates as a pet funeral service provider and has the authority to select the crematory for my pet. All selected crematories will undergo extensive evaluation to ensure they meet Angel Paws USA's minimum standards of care. We are committed to selecting the best crematory in the area to provide exceptional service.

11. Package Details and Delivery Times

• Results and Reporting (Necropsy/Autopsy): Preliminary results will be communicated via telephone within 48 hours of the gross examination. The final report will be completed within 10-12 business days (specialized testing may extend this timeframe), followed by a scheduled call for a comprehensive discussion of the case. Should specialized testing be pending and extend the turnaround time, an updated communication will be provided via email.
• Package Contents: Angel Paws USA reserves the right to modify package items. While we endeavor to provide the items listed in our packages, we retain the right to substitute or alter items if they are unavailable or for any other requisite reasons.
• Estimated Package Ready Time: Packages are typically ready within 7-10 business days, (excluding weekends and holidays). Please be advised that this is an estimated timeframe, not a guaranteed completion date.
• Unclaimed Packages: After a period of 15 days, a storage fee of $50 will be assessed. Should the packages remain unclaimed 30 days after notification of their readiness, they will be subject to disposal, and no refund will be issued.

12. Dispute Resolution

• Initial Resolution Steps: In the event of any dispute arising from or in connection with this Agreement, the Parties mutually commit to initially endeavoring to resolve the dispute through good-faith negotiations.
• Mediation: If the Parties are unable to achieve a resolution through negotiation within a period of 30 days, either Party may initiate mediation by providing written notice to the other Party. The Parties shall then select a mutually agreeable mediator or, if unable to reach a consensus, may request mediation services from a recognized mediation organization. Mediation shall proceed in accordance with the established rules and procedures of the chosen mediation organization.
• Legal Action: Should mediation fail to result in a resolution of the dispute, the Parties concur that any ensuing legal action shall fall under the exclusive jurisdiction of the Miami-Dade County courts. Each Party hereby consents to the personal jurisdiction of the Miami-Dade County courts and waives any objection to venue therein.

13. Intellectual Property

Rights and Protections: All content, trademarks, logos, and other intellectual property associated with Angel Paws USA are protected by copyright and trademark laws. Unauthorized use or reproduction without express consent is prohibited.

14. User Generated Contributions

Rights of Use: Submitted reviews, testimonials, or photos may be used by Angel Paws USA for promotional purposes. Contributors retain the rights to their submissions.

15. Prohibited Activities

Customer Conduct: Customers are expected to act with respect and understanding. Disruptive or harmful behavior may result in termination of service.

16. Termination of Service

Refusal of Service: Angel Paws USA reserves the right to refuse or terminate services for nonpayment, disruptive behavior, or failure to comply with the terms.

17. Guarantees and Quality Promises

Service Standards: Angel Paws USA adheres to industry-leading standards. Specific quality guarantees will be communicated as appropriate.

18. Electronic Communications

Communication Methods: By using our services, customers consent to receive communications by email, SMS, or other electronic means.

19. Third Party Links or Services

External References: Angel Paws USA may suggest third-party services or products. We are not responsible for the content or quality of these offerings.

20. Refund or Problem Resolution Process

Service Concerns: All sales are final. Any complaints or concerns regarding the services received can be directed to customer service for further consideration.

21. Data Protection, Privacy and Customer Confidentiality

• Handling of Personal Data: Angel Paws USA respects customer privacy and handles personal data in accordance with data protection laws.
• Use: Personal data is used solely to provide the requested services. No disclosure will be made to third parties without the client's explicit consent, unless such disclosure is mandated by law.
• Customer Confidentiality: Angel Paws USA is committed to maintaining the confidentiality of all customer information, including personal and medical information.

22. Commitment to Empathy and Care

Customer-Centric Approach: Angel Paws USA is committed to providing services with empathy and understanding, ensuring clients feel supported during difficult times.

23. Terms of the Agreement and Jurisdiction

• Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
• Entire Agreement: This Agreement constitutes the entirety of the agreement between the Parties and supersedes all prior agreements, understandings, and representations, whether oral or written. No modification or amendment of this Agreement shall be effective unless executed in writing and signed by both Parties.

24. Release, Certification and Responsibility

• Release of Liability: I/We hereby agree to release and indemnify Angel Paws USA removal staff, the removal service, crematory, their agents, and employees from any and all claims, liabilities, costs, or expenses.
• Limit of Liability: The liability of Angel Paws USA for any negligent actions/acts is limited to a refund of fifty dollars ($50.00).
• Certification: All representations and statements contained within this document are affirmed to be true and accurate. I/We confirm that I/We have read and comprehended the contents of this document.

By affixing a signature, providing agreement, or submitting this Agreement, both Parties acknowledge their understanding and acceptance of the terms and conditions herein. The Parties further understand that any deposit tendered is non-refundable, and any disputes shall be resolved in accordance with the Dispute Resolution clause set forth above.
